Auctioneering qualifications

Candidates are required to pass the four units listed below, they can be completed in any order. Once all four units have been passed, Propertymark Qualifications will provide certification for the full qualification.

Unit 1: Health and Safety, Security and General Law

Unit code: COM1 | England, Wales and Northern Ireland
Unit code: SCOM1 | Scotland

Understand the general concepts of law relevant to a property professional. It deals with the historical development of the law as well as current concepts, relevant statute and common law.

Learning outcomes:

1. Understand health and safety at work legislation and its relevance in and out of the workplace
2. Understand the issues around keeping safe when visiting property and maintaining a secure system when dealing with keys
3. Understand the general legal concepts relating to the provision of property services
4. Understand the common law duties of agents and agents’ authority
5. Understand the basic elements of the law of contract
6. Understand the basic elements of liability outside the law of contract
7. Understand the basic concepts of land law
8. Understand the basic concepts of discrimination
9. Understand the requirements of the data protection legislation
10. Understand the requirements of the legislation dealing with the handling of money

Unit 2: Law Relating to Real Property Auctions

Unit code: RPA2

Focuses on the laws specific to carrying out residential property sales including auction sales.

Learning outcomes:

1. Understand the legal framework as it applies to estate agency
2. Understand the legislation and guidance as applied to auctioneering
3. Understand the common law and legislative protection available for consumers
4. Understand matters relating to development and ‘For Sale’ boards under the planning legislation
5. Understand restrictions and regulations covering provision of financial advice
    

Unit 3: Real Property Auctioneering Practice and Procedures

Unit code: RPA3

How auctioneers should conduct themselves when carrying out residential sales and auctions in order to comply with all relevant statute, common law and principles of best practice.

Learning outcomes:

1. Understand the different types of agency
2. Understand key agency terms 
3. Understand the different methods of sale for residential property
4. Understand the requirements to provide associated documentation including a valid EPC
5. Understand the requirements of different types of seller
6. Understand the purpose and requirements of the Auction Guidance Note and the common auction conditions
7. Understand the different types of auction and auction best practice
8. Understand basic marketing techniques and the role of advertising, selling and IT in estate agency

Unit 4: Property Appraisal and the Auction Process

Unit code: RPA4

Legal and technical factors relating to an auctioneer preparing for and carrying out a property appraisal.

Learning outcomes:

1. Understand the factors affecting property value
2. Understand the property appraisal process
3. Understand staff responsibilities to sellers and buyers
4. Understand how to deal with offers made on properties for sale
5. Understand the role of others in the house buying/property auctioneering process
6. Understand the extent of the auctioneer’s authority
7. Understand the procedures to be adopted following the auction

Learners who wish to enhance their auctioneering skills can advance to the Level 3 Award in Chattels Auctioneering. Alternatively, those interested in the property sector can pursue the Level 3 Certificate in Property Agency, choosing from pathways in sales, commercial, or lettings.

Property agency management qualifications

Those advancing into management roles can also move onto the Level 4 Certificate in Property Agency Management, building the leadership skills essential for career growth.

Focuses on the laws specifically for chattels auction sales. It stresses the importance of understanding and complying with statutory requirements for chattels sales and understanding the auction-specific requirements of general goods and those within specific categories.

1. Understand the authority of the auctioneer
2. Understand legislation specific to auctioneering
3. Understand consumer protection legislation applicable in the auctioning of chattels  
4. Understand legislation covering the conditions of sale and the contract made at the auction sale

Unit 3: Practice and Procedures relating to Chattels Auctioneering

Unit code: CHAT3

Protocols and actions in the presence of colleagues and customers in and outside of the office and at auction venues. It covers the rights that auctioneers have against the seller, the buyer and third parties.

Learning outcomes:

1. Understand the content and requirements of the Auction Guidance Note published by RICS
2. Understand the standard terms in consignment agreements
3. Understand the auctioneer’s rights against the seller of chattels at auction
4. Understand the auctioneer’s rights against the buyer of chattels at auction
5. Understand the auctioneer’s rights against third parties involved in chattels auctions

Unit 4: Appraisal and the Auctioneers Duties and Liabilities in Relation to Chattels

Unit code: CHAT4

Concerns the valuation and marketing of chattels, remote bidding, post-sale procedures and duties of the auctioneer when buying their principal's chattel. The auctioneer's duties to the seller, buyer and third-parties post auction are also covered.

Learning outcomes:

1. Understand the factors affecting the value of chattels
2. Understand staff responsibilities when purchasing chattels, dealing with remote bidding and post-sale procedures
3. Understand the auctioneer’s duties to the seller
4. Understand the auctioneer’s duties to the buyer
5. Understand the auctioneer’s duties to third parties
