What is Regulation 7?
Referring to a specific direction that requires consent from the council to display estate agents' boards, Regulation 7 is designed to prevent excessive or inappropriate displays of boards, protecting the unique characteristics of neighbourhoods, particularly in conservation areas.
When Regulation 7 is in place, property agents must obtain council consent before erecting boards. This adds a layer of control beyond the Town and Country Planning (Control of Advertisements) Regulations 2007, which already regulate size, location, and duration.
Support for maintaining standards
Propertymark acknowledges the importance of preserving Westminster’s distinctive architectural heritage and supports measures to remove unnecessary street clutter. Many areas in the city are designated as conservation zones, making it vital to maintain high visual standards.
However, any changes to the Regulation 7 Direction must balance these considerations with the needs of property agents and the wider housing sector. While we appreciate the council's objectives, several areas require clarification and further consideration:
We have requested data to evaluate the current Regulation 7 Direction’s impact, including enforcement statistics, the number of sales and lettings boards in these areas, and evidence of issues with boards outside the current enforcement zones.
Potential delays in housing transactions
Requiring permission could introduce property sales and rental processes delays. Propertymark has asked the council to explain how permissions will be granted and the timelines for decision-making to avoid unnecessary disruptions.
Assured Advice 8: Joint agency boards
Two agents are instructed on a joint agency agreement to sell a property. When one agent secures an offer what should the other agent do to comply with Consumer Protection Regulations?
Recommendations from Propertymark
To streamline implementation and minimise disruption, there should be an exemption for our members. We have also offered to work closely with Westminster City Council to improve information sharing, promote best practices, and enhance compliance standards across the city.
Practical, fair, and effective solutions are what Propertymark is advocating for the local communities and the property industry. By requesting robust data and offering constructive recommendations, we aim to ensure that any extension of the Regulation 7 Direction achieves its objectives without hindering the housing market.
